Sexual Harrassment
Conduct can amount to sexual harassment even if:
- the “victim” does not express offence at the time the harassment occurs; or
- the “victim” has also engaged in conduct that could itself amount to sexual harassment - for example divulging details about their own sexual activities.
NOTE: It is not sexual harassment for work colleagues (outside of the workplace during non-work hours) to be in a genuinely consensual relationship. However, employees must take care not to blur the lines between their work and private lives - particularly once a relationship ends.
